高院再發回　張德正在家過年有變數

開砂石車衝撞總統府的張德正昨天被台北地院裁定責付給3位律師順利回家過除夕與家人圍爐，但經檢方再向高院提起抗告，高院凌晨4時許裁定將全案發回北院重新裁定。預計台北地院今天將再開羈押庭，張是否順利在家過年還有變數。

高院裁定指出，檢方是以高度再犯殺人重罪的危險性聲請羈押張德正，而張經台大醫院治療後可返家，使用輪椅可以行動，對照張之前自白書「如果沒死..沒關係，不管出來是幾歲，用走路的到總統府..」等所述，台北地院裁定將張責付給3位律師的理由都沒有完備，所以撤銷原裁定，發回北院重裁。（林益民／台北報導）
