防狼噴霧新用途　趕人酒測

【許淑惠／台中報導】中市尚姓男子(35歲)去年8月10日凌晨，開車行經台中市大里區德芳南路時，看見前方有警員執行酒測，尚男立刻轉彎逆向駛入巷道內停車，些微開啟車窗後，熄火反鎖車門在內閉目，警員發覺上前拍打車窗要求他下車酒測，尚男置之不理，雙方僵持了1個多小時，警員大喊：「你是不是男人？」後來施姓警員拿出防狼噴霧劑朝車窗縫隙內噴灑，才逼得尚男下車受檢，測得酒精濃度每公升0.26毫克。
 
尚男被依公共危險罪起訴後，質疑會被測得酒精濃度0.26毫克，是因警方的防狼噴霧劑含酒精成份。但台中地院調查，該牌防狼噴霧劑未含酒精成份，警員是因擔心打破車窗造成車主更多損失，且雙方已僵持1個多小時，尚男有酒駕嫌疑又是現行犯，警員噴灑防狼噴霧劑並未違反比例原則，依公共危險罪判尚男3月，得易科罰金9萬元。
