飲料店店內客人販毒，飲料店之持有人無預見可能性
結果是該持有人不構成故意
但是有加註"不等於無保證人地位"

我想問，在持有人無預見可能性的情況下
還是負有保證人地位嗎?
可以認為「場所之持有，必負監督義務」嗎?
